Revisions are limited to what is stated in the project agreement. Additional revisions may incur extra costs.

6. Client Responsibilities

Clients agree to:

• Provide accurate information and timely feedback.
• Respond to requests for content, assets, or approvals promptly.
• Ensure all submitted content (e.g., images, logos, text) is owned by them or licensed appropriately.

Creative Fosters is not responsible for delays caused by client non-responsiveness.

7. Fees and Payment Terms

• A non-refundable deposit (typically 50%) is required before work begins.
• Final payment is due prior to delivery or deployment of final deliverables.
• Payments can be made via bank transfer, credit card, or other approved methods.
• Late payments may incur interest charges and can result in suspension of work or termination of the project.

8. Refund Policy

All payments made are non-refundable unless explicitly agreed upon in writing. In exceptional cases where a refund is granted, it will be based on work not yet completed or delivered.

9. Intellectual Property

All intellectual property created by Creative Fosters remains the property of Creative Fosters until full payment is received. Upon final payment:

• The client is granted ownership of the final approved deliverables.
• Creative Fosters retains the right to showcase the work in its portfolio, marketing materials, or social media unless the client requests otherwise in writing.

Clients may not reproduce, distribute, or create derivative works from our content or designs without express written consent.

10. Third-Party Services

Creative Fosters may recommend or use third-party services (e.g., hosting, CMS platforms, plugins). We are not responsible for the performance, reliability, or security of any third-party services.

Clients are responsible for maintaining their own accounts and subscriptions with such third parties.

11. Confidentiality

Both parties agree to treat all non-public business, technical, and financial information disclosed during the project as confidential. This obligation remains in force even after the termination of the project.

12. Limitation of Liability

To the maximum extent permitted by law, Creative Fosters shall not be liable for any indirect, incidental, consequential, or special damages resulting from your use or inability to use our services. Total liability shall not exceed the amount paid by the client for the specific service in question.

13. Warranties & Disclaimers

We do not warrant that our website or services will be uninterrupted or error-free. All services are provided “as is” without warranties of any kind, express or implied, including but not limited to merchantability or fitness for a particular purpose.

14. Termination

Either party may terminate the agreement with written notice. In case of client-initiated termination, the client shall pay for all work completed up to the termination date.

Creative Fosters reserves the right to terminate a project at any time due to breach of terms, client misconduct, or non-payment.

15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Melbourne, Australia. Any disputes shall be resolved in the courts of Melbourne, and you consent to the exclusive jurisdiction of those courts.

16. Changes to Terms

We may revise these Terms at any time. Changes will take effect immediately upon being posted on our Site. Your continued use of our services constitutes acceptance of the revised Terms.
